Curative Amendment Parking Lot Proposal - appealed

Rose Tree Associates filed an appeal in the Delaware County Court of Common Pleas on July16, 2015 challenging the unanimous decision by Ridley Park Borough Council to deny Rose Tree Associates a Curative Amendment.

Rose Tree Associates sought an amendment to the Borough's code to allow remote parking in Ridley Park for their Medical Building at 23 Chester Pike.  The proposed site of the remote parking is presumed to be the vacant lot at 32 W Sellers, however other properties within 300 feet of the Medical Building at 23 Chester Pike qualify as future parking lots.

Rose Tree Associates brings their latest appeal after their denial before the Zoning Hearing Board, their denial on appeal to the PA Superior Court, a second denial before RP's Zoning Hearing Board and a recent unanimous denial by Borough Council.

The Attorney for Rose Tree Associates is Delaware County Councilman John McBlain.

Thanks Mike for letting us know about the billboard ruling but I wish you had added it as a seperate blog.  Now we have one blog with two subjects, people's comments on one subject will get mingled in with the other.

Appeal Granted

H.A. Steen Industries, Inc. v. Zoning Hearing Board of Ridley Park.

On May 12, 2014 the Zoning Hearing Board of Ridley Park denied a request from Steen Industries to raise the height of the billboard located at 708 Ketchum Avenue. Steen appealed to the Delaware County Court of Common Pleas. On June 26, 2015 judge G. Michael Greene ruled in favor of Steen Industries and futher ordered the RP Zoning Board to issue a permit to raise the height of the billboard within 45 days of the order.

The Ridley Park Zoning Hearing Board scheduled a meeting to discuss this issue Thursday July 23, 2015 at 7 PM at Boro Hall.

Interested parties should plan to attend.

Rose Tree Associates just won't give up. Just keep on paying Delaware County Councilman John McBlain.
